The Supreme Court errs in its telecom judgment by foraying into policymaking and setting bad policy. The Supreme Court verdict on telecom licences has two redeeming features : it establishes the likelihood of judicial review of flawed executive decisions; and, therefore, sets limits on coalition compulsions. A coalition’s junior partners will continue to have elbow-room disproportionate to their size, but not enough for taekwondo. However, the Court has forayed into policymaking and come out smelling of things that all the perfumes of Arabia cannot sweeten.
