Should mercy be slave to political expediency?

The continuing campaign for abolition of death penalty surely has had its impact on the Indian criminal justice system even though domestic laws still retain capital punishment in culpable homicide cases. Courts in India have been extremely reluctant to impose death penalty in simple murder cases where previous enmity, disputes over property, or sudden and grave provocation results in the murder of a person.
